શ્રીમાન,

              જયભારત સહ ઉપરોક્ત વિષય અને સંદર્ભ પરત્વે જનાવવાનું કે સંદર્ભદર્શિત ક્રમાંક -૧ ની આપની અરજીના અનુસંધાને નિચેની વિગતે માહિતી આપીએ છીએ

(૧) શાળાના કર્મચારી શ્રી લીલાભાઈનું તા.૨૭/૧૦/૧૯૯૧ ના રોજ અવસાન થયેલ હતું તે પછી આજદિન સુધી તેમના વારસદારો એ રહેમરાહે નોકરી માટે દાવો કરેલ નથી કે કોઈ રજુઆત કરેલ નથી.

(૨) શ્રી લીલાભાઈ દેસાઈના અવસાન સમયે બિન સરકારી માધ્યમિક શાળાઓના કર્મચારીઓ માટે રહેમરાહે નોકરી આપવાની યોજના અમલમાં નહોતી કારણ કે  ઉચ્ચ શિક્ષણ કમિશ્નર કચેરીની પત્ર નં – અનુદાન-૧-ચ-૮૦૦૩-૨૨ તા. ૧૧-૮-૧૯૯૨ માં જણાવ્યા મુજબ તા.૧-૧૨-૧૯૯૧ પછી મુત્યુ પામનાર કર્મચારીના કિસ્સામાં આ યોજના અમલી બનસે તેવું જનાવવામાં આવેલ હતુ તેથી અત્રેની શાળાને કોઈ કર્યવાહિ કરવાની થતી ન હતી.

(૩) વધુમાં જણાવીએ તો શ્રી લીલાભાઈ દેસાઈની અવસાન સમયે તેમના કુટુબના સભ્યો બિન સરકારી માધ્યમિક શાળામાં નિમણુંક માટે નક્કી થયેલ નિયત લાયકાત ધરાવતા ન હતા.

(૪) શ્રી લીલાભાઈ દેસાઈના સગીર બાળકોએ પણ નોકરી મેળવવા માટેની ન્યુતમ ઉમરના થયા પછી આજ દિન સુધી રહેમરાહે નોકરી માટે અરજી કરેલ નથી તેથી હવે સમય મર્યાદા પછી કોઈ દાવો સ્વીકારી શકાય નહી તેવુ અમારુ સ્પષ્ટ માનવુ છે.

(૫) સરકારશ્રીના સામાન્ય વહિવટી વિભાગના તા.૧૦-૦૩-૨૦૦૦ ના ઠરાવ ના મુદા નં.-૩ માં જણાવ્યા મુજબ  આ ઠરાવ હેઠળની રહેમરાહે નિમણુંકો આપવાની આયોજનાને કોઈ બંધારણીય પીઠબળ નથી એટલે આ યોજના હેઠળ રહેમરાહે નિમણુંક માટે કોઈ હક પ્રસ્થાપિત થતો નથી પણ અન્યોના કેસોની જેમ જ નિમણુંક માટેની અન્ય તમામ શરતો સંતોસવાને અધિન રહેશે.
